Yesterday, the Supreme Court heard a case that could restore balance to global trade, rein in executive overreach, and (potentially) refund the unlawful tariffs that businesses like mine have been forced to pay just to stay afloat.Wild Rye joined an amicus brief filed last month through We Pay the Tariffs, an organization of small and midsize businesses advocating against the use of the International Emergency Economic Powers Act (IEEPA) to justify broad import tariffs.At the center of the case is one question: can the President use emergency powers to impose tariffs without Congress? The Constitution clearly assigns taxing authority to Congress, yet recent administrations have used IEEPA to levy billions in tariffs under the banner of “national emergency.”As a founder, I will continue to fight like h*ll while remaining optimistic.
